Political Investigation
Overview
Political investigation (政治搜査; 정치수사) refers to criminal investigations conducted by state investigative agencies such as the prosecution, police, and the Corruption Investigation Office for High-ranking Officials (CIO) against political actors including politicians, political parties, election camps, and senior government officials. In a narrow sense, it denotes investigative activity dealing with politically sensitive cases; in a broad sense, it refers to the entire phenomenon in which the exercise of investigative authority itself is swayed by political interests. Accordingly, political investigation is treated not merely as a matter of law enforcement but as an issue directly linked to separation of powers, judicial independence, and the health of democracy.

Concept and Boundaries
The term 'political investigation' itself is not an official concept under positive law but an analytical expression used in politics, media, and academia. The criterion distinguishing ordinary criminal cases from political investigations lies not in the status of the subject (whether they are a politician) but in the case's relevance to structures of political conflict. Election law violations, political fund law violations, bribery, abuse of authority, insurrection and foreign aggression, and political involvement by the National Intelligence Service, police, and prosecution are typical areas.
Institutional Actors
- Prosecution: Based on the monopoly on indictment and the authority to request warrants, it has functioned as a key actor in political cases.
- Police: After the launch of the National Investigation Headquarters, it secured the authority to close first-stage investigations, expanding its involvement in political cases.
- CIO: The Corruption Investigation Office for High-ranking Officials, launched in 2021, has investigative and prosecutorial authority over crimes by high-ranking public officials and became a new axis in discussions of neutrality in political investigations.
- Special prosecutor (특검): An exceptional mechanism to bypass conflicts of interest or institutional self-case recusal, placed at the forefront of political conflict between ruling and opposition parties.
- NIS and military intelligence agencies: Past cases of political involvement have been repeatedly revealed, making them objects of oversight and control.
Key Issues
1. Selective investigation: The core criticism is that investigations are concentrated only on a particular political faction despite similar allegations, or conversely, that leniency is granted.
2. Abuse of investigative authority and human rights: Search and seizure, detention, media exposure, and public disclosure of suspected facts can function as de facto political sanctions.
3. Abuse of indictment authority: Whether excessive indictments and non-indictment dispositions were made according to political judgment.
4. Devices to secure institutional neutrality: Investigative review, substantive warrant review, special prosecutors, parliamentary inspections, and media and civil society oversight.
5. The problem of political motives: As the timing of initiating and concluding investigations overlaps with elections, impeachments, and political situations, suspicions of political calculation are raised.
Historical Flow in South Korea
During the military regime period, the prevailing assessment is that intelligence and investigative agencies were used as tools for maintaining the regime. Even after democratization, political investigation controversies repeatedly arose over cases such as national discipline disturbance cases, illegal presidential election fund investigations, judicial power abuse allegations, the Druking comment manipulation case, and corruption investigations involving key figures in power. As the 2019 prosecution reform debate and the Cho Kuk incident, and in the 2020s cases involving Representative Lee Jae-myung and cases involving ruling camp figures proceeded simultaneously, assessments emerged that the 'camp versus camp' structure intensified.
Comparative Legal Perspective
The United States developed a structure to avoid executive branch conflicts of interest through the Special Counsel system, with the Watergate, Clinton, and Russia scandal investigations as representative examples. France has the examining magistrate and the National Financial Prosecutor's Office (PNF), and Italy experienced large-scale investigations targeting the entire political world through the 1990s 'Mani Pulite' investigations. Each country faces the task of designing institutions that secure both independence and accountability of investigative agencies.
Latest Trends (2024–2025)
The declaration of martial law on December 3, 2024 and the subsequent impeachment political situation greatly changed the landscape of political investigation discussions. As investigations into charges of insurrection and foreign aggression unfolded in an unprecedented structure in which the prosecution, the CIO, and the police proceeded in parallel, conflicts among investigative bodies and jurisdictional disputes came to the fore. In 2025, following the Constitutional Court's removal decision and an early presidential election, trials related to major politicians and discussions of special prosecutor bills proceeded simultaneously.
In particular, as the ruling and opposition parties each pushed special prosecutor bills targeting the opposing camp, criticism was raised that the special prosecutor had become a 'regularized tool of political investigation.' At the same time, discussions on separating investigation and indictment, such as abolishing the Prosecutors' Office, establishing a Public Prosecution Office, and introducing a Serious Crimes Investigation Agency, began in earnest, and redefining the role of the CIO and adjusting investigative authority also emerged as key agenda items. Public opinion polls show that trust in the fairness of political investigations is sharply divided by camp, and whether institutional reform can lead to actual restoration of trust remains a key question for the future.
