Kim Soo-hyun Defamation
Overview
The Kim Soo-hyun defamation case refers to a series of disputes in early 2025 in which actor Kim Soo-hyun's side took legal action against disseminators on charges of defamation and spreading false information, claiming that allegations raised by YouTube channels and others regarding an alleged romantic relationship between actor Kim Soo-hyun and the late Kim Sae-ron were untrue. This matter drew social attention as a representative case where reporting on celebrities' private lives, freedom of expression, and criminal and civil liability for stating false facts collide. As allegations involving a minor became intertwined, the controversy expanded beyond a legal dispute into a debate over public opinion and ethics.
Key Details
Background
In March 2025, some media outlets, including the YouTube channel 'Garosero Research Institute,' raised claims to the effect that Kim Soo-hyun had been in a long-term romantic relationship with Kim Sae-ron since she was a minor. Along with this, various allegations related to debt relations, agency contracts, and private life were reported and spread in succession. Kim Sae-ron had died in February 2025, and as representatives of the bereaved family and some media outlets announced further revelations, the controversy grew rapidly.
Claims Between the Parties
Kim Soo-hyun's agency, Gold Medalist, rebutted that the period during which Kim Soo-hyun dated Kim Sae-ron was from the summer of 2019 to the autumn of 2020, after Kim Sae-ron became an adult, and that the claim that they dated when she was a minor was not true. On the other hand, the bereaved family's side and some channels maintained the position that the relationship began around 2015 and released various materials. The two sides clashed head-on over the disputed timing and the authenticity of the materials.
Legal Issues
Article 307 of the Criminal Act establishes defamation when a person alleges facts or false facts to lower a person's social evaluation; if information and communications networks are used, Article 70 of the Information and Communications Network Act applies and may result in aggravated punishment. The key issues are (1) whether the alleged content is a 'statement of fact' or an 'expression of opinion,' (2) whether it is a true fact that serves the public interest, and (3) whether the disseminator was aware that it was false. In addition, alleging false facts about a deceased person can also raise issues under Article 308 of the Criminal Act, defamation of the dead. In the case of broadcast and YouTube content, the boundary between public interest as 'monitoring public figures' and indiscriminate expanded reproduction becomes central to judgment.
Progress
In March 2025, Kim Soo-hyun's side submitted a complaint on charges of defamation and spreading false information, and announced that it would consider criminal accusations against the operator of Garosero Research Institute and others, as well as civil claims for damages. On the 31st of the same month, Kim Soo-hyun held a press conference and personally stated his position, and his agency also announced legal action regarding malicious online posts and secondary victimization. Police received the complaint and began an investigation, and the related channel responded in kind by announcing additional disclosure of materials. Given the nature of the matter, the possibility that the investigation and trial could be prolonged was raised.
Latest Developments
In South Korean society in 2024–2025, disputes over the boundary between online and YouTube-originated revelations and defamation have been occurring one after another. The Kim Soo-hyun case was also treated as one of the biggest entertainment and social issues of the first half of 2025, bringing to the fore both the responsibility to verify the truth of reports on celebrities' private lives and the responsibility of platforms for their spread. As allegations involving a minor, conflict with the bereaved family, and the question of whether advertising and work contracts were terminated became intertwined, the matter went beyond a simple defamation lawsuit into a social debate over a 'revelation culture without fact-checking.' In the legal community, observations emerged that whether facts were stated, the limits of freedom of expression, and the level of punishment for false reports and dissemination could influence future case law. Meanwhile, as various rumors were indiscriminately reproduced, secondary harm and cyber violence were also pointed out, and the need to strengthen verification obligations for platforms and the press was raised.
