Letter of Appeal
Overview
A letter of appeal (Korean: 탄원서; 歎願書) is a document prepared by an individual or organization to convey a plea for leniency, an appeal, or a request regarding a specific matter to a public institution such as an investigative agency, court, or administrative agency. It is mainly used in criminal cases for the purpose of seeking lenient treatment for a defendant or suspect, but it is also widely used in discretionary decisions on administrative dispositions, licensing, and disciplinary procedures. Although it is not a clearly defined litigation act in legal terms, it becomes important material that a court or the responsible institution can consider as a factor for mitigating circumstances or sentencing.

Definition and Legal Nature
A letter of appeal is closer to a discretionary document submitted as reference material in investigative or trial proceedings than to a 'litigation document' expressly stipulated under the Civil Procedure Act or Criminal Procedure Act. Therefore, the letter of appeal itself does not automatically produce any specific legal effect, and functions as supplementary material for the discretionary judgment of a judge or investigator. However, because preparing or submitting a letter of appeal containing false content may become problematic in relation to Article 151 of the Criminal Act, which covers the crimes of harboring or aiding a criminal to escape, or provisions related to perjury, the truthfulness of the content is required.
Types
- Criminal letter of appeal: The most representative form, requesting leniency, suspension of execution of sentence, or reduction of sentence for a suspect or defendant.
- Administrative letter of appeal: Used when requesting reduction of an administrative disposition such as suspension of business or revocation of a license, or when requesting a license or permit.
- Disciplinary letter of appeal: A document appealing for mitigation in a disciplinary procedure of an organization such as a school, company, or association.
- Petition-style letter of appeal: Also includes documents of a collective nature demanding improvement of a specific policy or system.
Preparation Requirements
There is no strictly prescribed format for a letter of appeal, but to increase its effectiveness, it is common to include the following elements.
1. Personal details: The petitioner's (writer's) name, resident registration number, address, contact information, and relationship to the person for whom the appeal is made (the subject)
2. Case overview: Case number, case name, court or investigative agency in charge
3. Purpose of the appeal: A clear request seeking leniency
4. Reasons for the appeal: Specific grounds such as the subject's usual character, social contributions, degree of reflection, efforts to recover damage, and family or social ties
5. Signature and seal: The writer's handwritten signature or seal, and, if necessary, joint signatures
Submission Procedure
During an ongoing trial, it is submitted to the court; at the investigation stage, it is submitted to the prosecutor in charge or a police investigator. To be used as sentencing material, it is effective to submit it before sentencing or before the prosecution's sentencing recommendation if possible. When multiple letters of appeal are collected and submitted, individual documents containing the specific statements of each petitioner are given more credibility than a simple list of signatures.
Effect and Limitations
A letter of appeal is only reference material, so submitting it alone does not exempt one from punishment or automatically reduce the sentence. The court comprehensively considers various sentencing factors, such as the gravity of the case, whether the damage has been recovered, and the attitude of reflection. In addition, formal and repetitive letters of appeal submitted by interested parties may rather lower their credibility.
Recent Trends
As of 2024–2025, changes are also being observed in the ways letters of appeal are written and used. First, with the expansion of online filing and electronic document submission, submissions of sentencing materials through the electronic litigation systems of courts and prosecutors' offices are increasing. Second, cases have increased in which collective appeal and signature campaigns via social networking services (SNS) or online petition platforms are conducted alongside institutional letters of appeal. Third, in trial practice, while the proportion of specific letters of appeal containing sincere reflection and efforts to recover damage is growing, a strict attitude is maintained toward so-called 'solicitation-style letters of appeal' that rely on personal connections or status. Fourth, as cases of using generative AI to draft letters of appeal increase, the authenticity of the content and whether the writer personally handwrote and signed it are becoming more important.
