Rear-End Collision
Overview
A rear-end collision (追突, chudol) is a type of traffic accident in which a moving or stopped vehicle strikes the rear of the vehicle ahead of it from behind. Under the Road Traffic Act, the duty to maintain a safe distance and the duty to watch the road ahead become the core issues, and in most cases the following vehicle is found to bear the greater fault. Because the range extends from simple contact accidents to multi-vehicle pileups and large-scale accidents involving casualties, fault-ratio calculation, insurance handling, and criminal and civil liability become intricately intertwined.

Definition and Types
Rear-end collisions are broadly divided into single rear-end collisions and chain (multi-vehicle) collisions. A single rear-end collision is the most common form, occurring between two vehicles, while a chain collision is a form in which multiple vehicles strike one another in succession on expressways, in tunnels, or in foggy or heavy-snow sections, and the scale of casualties grows larger. The criteria for determining liability differ by situation, such as a rear-end collision while stopped, a rear-end collision while decelerating, a rear-end collision caused by sudden braking, and contact with a reversing vehicle. In addition, not only car-to-car rear-end collisions but also rear-end collisions with two-wheeled vehicles and personal mobility devices (PM), such as motorcycles, bicycles, and electric kickboards, are treated within the same category.
Causes
Failure to secure a safe distance and inattention to the road ahead are the biggest causes. Distracting factors such as smartphone use, navigation manipulation, and drunk or fatigued driving are typical. On top of this, the fault of the leading vehicle—such as sudden braking, illegal stopping on the shoulder, sudden lane changes, and reckless cutting in—also works in combination. Weather conditions are also an important variable: heavy rain, heavy snow, fog, and insufficient nighttime lighting increase braking distance and sharply raise the risk of a rear-end collision. Congested expressway sections, tunnel entrances, and the areas in front of tollgates are typical danger points where rear-end collisions are concentrated.
Fault Ratio and Legal Liability
In rear-end collisions, the following vehicle is normally found to bear 70–100% of the fault. However, if the leading vehicle's sudden braking, stopping without reason, reversing, or sudden lane change is proven, the leading vehicle's fault is reflected and the ratio is adjusted. In Korea, the 'Fault Ratio Recognition Standards for Automobile Accidents' serves as the reference table, and when a dispute arises, it is resolved in the order of fault-ratio deliberation by the Korea Insurance Development Institute, consultation between insurance companies, and the judgment of the court. As for criminal liability, violations of the duty to maintain a safe distance and the duty to watch the road ahead under the Road Traffic Act apply, and if there are casualties, the Act on Special Cases Concerning the Settlement of Traffic Accidents (which depends on whether the case falls under the 12 major categories of gross negligence) or the Act on Special Cases Concerning the Aggravated Punishment of Specific Crimes (dangerous driving causing death or injury) may become an issue. Civilly, medical expenses, lost income due to absence from work, consolation money, vehicle repair costs, and losses from depreciation in market value are included in the scope of damages.
Insurance Handling Procedure
When an accident occurs, the key is to stop immediately, take safety measures, report to 112 or 119, and secure black box footage and on-site photographs. Even for a minor contact accident, it is safer to leave a record of the accident report in order to prevent 'staged accident' (insurance fraud) disputes. After that, the accident is reported to the insurance company, and if necessary, a fault-ratio deliberation is requested. In the process of calculating the settlement amount, medical certificates, treatment records, and income verification documents play an important role. In recent years, there have been increasing cases in which insurance companies use video analysis and accident data to automate fault determination.
Prevention and Safety Technology
Securing a safe distance is the most basic measure, and the 'safe distance formula'—generally taking the speed (km/h) minus 15 as the value in meters—is widely used in educational materials. On rainy days, a distance 20–50% longer than usual must be secured. In terms of vehicle technology, Forward Collision-Avoidance Assist (FCA), Autonomous Emergency Braking (AEB), rear cross-traffic collision warning, and Adaptive Cruise Control (ACC) contribute to preventing rear-end collisions. On the driver's side, it is important not to touch a smartphone and to make a habit of immediately resting at a rest area or drowsiness shelter when feeling sleepy while driving.
Latest Trends
In 2024–2025, as Advanced Driver Assistance Systems (ADAS) became standard equipment even on mass-market vehicles, the pattern of rear-end collisions is changing. Whether an accident involved the activation of automatic emergency braking has emerged as a key issue in fault determination and discussions of product liability, and disputes over whether the system malfunctioned or failed to activate are increasing among manufacturers, insurance companies, and drivers. In rear-end collisions involving vehicles with autonomous driving functions, the question of who was the driver—the issue of who bears responsibility—is newly coming to the fore.
In addition, black box footage and vehicle Event Data Recorder (EDR) data have established themselves as decisive evidence in fault-ratio rulings, and services that automatically read accident circumstances through AI-based video analysis are spreading. With the rapid increase in personal mobility devices such as electric kickboards and electric bicycles, rear-end collisions with them are also steadily rising, and discussions on institutional reform regarding two-wheeled vehicle insurance and the scope of liability continue. Policies to expand Intelligent Transport Systems (ITS) and emergency braking warning systems in accident-prone sections in response to multi-vehicle pileups on expressways are also gaining speed. Furthermore, along with the introduction of AI screening to detect insurance fraud, attempts at institutional improvement to simplify the settlement procedure for minor rear-end collisions are also under way.
