Application

The act or process of making abstract norms, principles, theories, or technologies correspond to and operate upon concrete factual circumstances or real-world situations.

Application

Overview

Application (適用) refers to the act or process of making abstract norms, principles, theories, technologies, standards, etc., correspond to and operate upon concrete factual circumstances or real-world cases. In law, the 'application of law,' which subsumes legal norms under specific cases, is a core procedure of adjudication; in pedagogy, it is treated as a higher-order cognitive stage in which learned knowledge is used in new situations. In almost all professional fields, including technology, medicine, and public administration, application functions as an essential procedure linking theory and reality.

Key Aspects

Etymology and Concept

'Application (適用)' is a Sino-Korean term formed by combining '適' (to fit) and '用' (to use), meaning 'to use appropriately.' That is, it means operating an abstract, general major premise (norm, principle, technology) by fitting it to a concrete, individual minor premise (fact, case). It corresponds to application in English and Anwendung in German, and its opposite concepts include exclusion, exemption, and non-application. Application is distinguished from mere execution in that it is an act of judgment establishing a 'correspondence relationship' between an object and a situation.

Application in Law

The application of law is the work of connecting abstract legal norms to concrete factual circumstances. It is traditionally explained through the syllogism (legal norm = major premise, facts = minor premise, conclusion = judgment), and the operation of matching facts to the constituent elements of a legal norm is called subsumption (Subsumtion).

  • Effective date: A statute takes effect from the effective date prescribed in its supplementary provisions and, in principle, is not applied to facts before that date.
  • Prohibition of retroactive application: Article 13(1) of the Constitution provides that no person shall be prosecuted for an act that did not constitute a crime under the law in force at the time it was committed, proclaiming the principle of non-retroactivity of criminal punishment. However, retroactive effect is recognized when it is favorable to the people, such as when the punishment becomes lighter.
  • Mutatis mutandis application (準用): A legislative technique of applying another provision to a specific matter by modifying it according to its nature.
  • Analogical application: Applying a similar provision to a matter not provided for by law; in criminal law it is prohibited by the principle of legality, but in civil law and elsewhere it is permitted.
  • Principles of application: The principle of priority of newer law, priority of special law, and priority of higher law determine the order of application among competing legal norms.

Application in Education

In the cognitive domain of Bloom's taxonomy, 'Applying' is located after 'understanding' and before 'analyzing.' It is the ability to use learned concepts, principles, and procedures in new situations, and in the 2001 revised edition (Anderson & Krathwohl) it is presented in verb form as 'apply.' It is closely connected to performance assessment, project-based learning, and the concept of transfer.

Application in Science and Technology

Whereas basic science aims at knowledge itself, applied science (application science) aims to apply research results to industry and society. Technology transfer, patent working, and the actual operation stage among the nine levels of TRL (Technology Readiness Level) are representative phases of application.

Application in Medicine

Indication and contraindication serve as criteria for determining whether to apply a treatment. Clinical application, off-label use, and application based on evidence-based medicine (EBM) are discussed.

Application in Public Administration and Policy

Enforcement of statutes, authoritative interpretation, and on-site application of administrative rules take place, and the consistency and equity of regulatory application are treated as important.

Recent Trends

  • Application of AI regulation: The EU AI Act took effect in August 2024, and regulation of high-risk AI has been applied in stages from 2025; South Korea also passed the 2025 Framework Act on AI (Framework Act on the Promotion of the AI Industry and Creation of a Trust Foundation, etc.), establishing an application system.
  • Generative AI and application of existing laws: How to apply copyright law and personal information protection law to AI training data and outputs is a key issue in 2024–2025.
  • Controversy over retroactive application: Debates continued over the timing of implementation and the application of transitional provisions in areas such as virtual asset taxation and the financial investment income tax.
  • Clinical application of medical AI: Along with the enforcement of the Digital Medical Products Act, clinical application of AI medical devices is expanding.
  • Application in education settings: AI digital textbooks began to be applied in schools from 2025.
  • Application of ESG and climate disclosure: The scope of application of climate-related disclosure obligations is gradually expanding.
